These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and New York American Smooth Camp ("we," "us," or "our"), concerning your access to and use of the https://www.nysmoothcamp.com website (the "Site") as well as any related media form, booking channel, or mobile application related, linked, or otherwise connected thereto.
By accessing the Site, registering for an account, purchasing tickets, or booking a coaching session, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, you are expressly prohibited from using the Site and must discontinue use immediately.
2. Use of the Site and Account Creation
To use certain features of the Site, such as purchasing tickets or booking private coaching sessions, you may be required to register for an account ("Become a Member").

You agree to provide true, accurate, current, and complete information about yourself during registration.

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
3. Purchases, Ticketing, and Booking Policies
We offer event tickets, coaching sessions, and potentially merchandise through the Site. By making a purchase, you agree to the following:

Pricing and Availability: All prices are subject to change without notice. We reserve the right to modify or discontinue any ticket package, coaching slot, or product at any time.

Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You authorize us (or our third-party payment processors) to charge your chosen payment provider for any such purchases.

4. Assumption of Risk and Waiver of Liability
New York American Smooth Camp involves physical exertion and dance activities. By purchasing a ticket or participating in the camp:

Assumption of Risk: You acknowledge that participating in dance workshops, coaching sessions, and related physical activities carries inherent risks, including but not limited to physical injury, strain, or illness. You voluntarily assume all such risks.

Medical Clearance: You represent that you are in good physical health and have no medical condition that would prevent your safe participation in the camp.

Release of Liability: To the maximum extent permitted by law, you agree to release, discharge, and hold harmless New York American Smooth Camp, Alexandra Perzhu, Peraginto, our coaches, staff, volunteers, and the venue (including the facility at 320 W 37th St, New York) from any and all liability, claims, or demands for personal injury, property damage, or loss that may occur during your participation in the event.
5. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.
You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any part of the Site, Content, or Marks for any commercial purpose whatsoever, without our express prior written permission.
6. User Conduct and Event Behavior
By using the Site and attending our events, you agree not to:

Use the Site in any manner that could disable, overburden, or impair the Site.

Engage in any harassing, threatening, intimidating, or predatory behavior toward other users, attendees, staff, or coaches.

We reserve the right to refuse service, terminate accounts, or revoke event tickets (without refund) if a user’s behavior violates these Terms or is deemed disruptive or unsafe to the event environment.
7. Third-Party Websites and Services
The Site may contain links to third-party websites (e.g., hotel booking portals, Instagram, Facebook, and the PulseFit App). Such Third-Party Websites are not monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site. Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites does not imply approval or endorsement thereof by us.
8. Disclaimer of Warranties
THE SITE AND EVENT SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF.
9. Governing Law and Dispute Resolution
These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding related to your access to or use of the Site or attendance at the event shall be instituted in a state or federal court in New York County, New York, and you agree to submit to the jurisdiction of, and agree that venue is proper in, these courts.
10. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or event.
